Terms of Use

These Terms of Use are an agreement between you and Scalable Growth LLC (“Scalable Growth,” “we,” “us,” or “our”) and govern your access to and use of Once. They supplement the Apple Standard End User License Agreement that applies to apps distributed through the App Store.
1. Acceptance
By downloading, accessing, or using Once, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Once. You must be legally capable of entering into these Terms in your jurisdiction.
2. The Service
Once provides tools for reviewing, organizing, rediscovering, understanding, and creating with photos and videos. Features may include automated analysis, personalized insights and reports, memory-based stories, and media arranged or transformed into collections, highlights, narratives, or videos. Features may change, be introduced gradually, require internet access, or depend on third-party services.
3. Your Content and Permission to Process It
You retain ownership of your photos, videos, and other content. You grant Once a limited, non-exclusive, worldwide permission to access and process content you make available to a feature solely to operate, provide, secure, and support that feature as described in these Terms and the Privacy Policy. If you separately enable a cloud feature, this permission includes hosting, copying, transmitting, analyzing, transforming, and creating the outputs you request. Photo-library permission by itself does not authorize future cloud processing. This permission lasts only as long as reasonably necessary for those purposes and ends subject to applicable retention obligations.
4. Automated and AI-Generated Results
Once may use automated systems and artificial intelligence. Results may be incomplete, inaccurate, unexpected, or unsuitable for a particular purpose. You are responsible for reviewing results before relying on, sharing, or publishing them. Once does not provide medical, legal, financial, psychological, or other professional advice.
5. Purchases and Subscriptions
Paid features may be offered through Apple in-app purchases. Prices, trial terms, renewal periods, and included features will be shown before purchase. Subscriptions may renew automatically unless canceled through your Apple account settings within the period specified by Apple. Billing, cancellation, refunds, and restore purchases are administered under Apple's applicable terms.
6. Acceptable Use
You may not misuse Once, interfere with the service, bypass limits or security controls, reverse engineer the app except where law permits, upload content you lack the right to use, violate another person's privacy or intellectual-property rights, use the service unlawfully, or attempt to harm Once, its providers, or other users.
7. Once Ownership
Scalable Growth and its licensors retain all rights in the app, service, software, design, branding, and related technology, excluding your content. No rights are granted except the limited right to use the service under these Terms and the Apple Standard EULA.
8. Availability and Changes
Once may add, modify, suspend, limit, or discontinue features and may release updates needed for security, compatibility, or operation. We do not guarantee that every feature, generated result, cloud service, or item of content will always remain available. Material changes affecting paid services will be handled in accordance with applicable law and App Store requirements.
9. Disclaimers
To the maximum extent permitted by law, Once is provided on an “as is” and “as available” basis without warranties of uninterrupted availability, error-free operation, accuracy, fitness for a particular purpose, or preservation of any specific result. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
10. Limitation of Liability
To the maximum extent permitted by law, Scalable Growth and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, opportunities, or goodwill arising from use of the service. Any limitation applies only to the extent permitted by applicable consumer law.
11. Suspension and Termination
You may stop using Once at any time. Once may suspend or terminate access when reasonably necessary to protect the service, comply with law, prevent harm or misuse, or address a material breach of these Terms. Provisions that by their nature should survive termination will continue to apply.
12. Apple Terms
Your license to use Once is also governed by Apple's Standard End User License Agreement and applicable App Store rules. These Terms are between you and Scalable Growth LLC, not Apple. Apple is not responsible for Once or its content, support, maintenance, warranties, or claims, except as required under Apple's applicable terms.
13. Changes to These Terms
Once may update these Terms as the service evolves. The current version will remain available in the app. If changes are material, Once may provide additional notice or request renewed agreement where required.
